1. General Information

1. The App is designed to assist users in tracking their weight, meals and calculating nutrient information, including calories, proteins, fats, carbs, sugars, and related data.
2. The App is accessed exclusively via mobile devices.
3. The App uses artificial intelligence (AI) to convert voice, text or photo input into meal descriptions and associated nutritional data. AI processing is performed by CalPal.Pro's server-side AI meal analysis service and may use contracted third-party AI processing APIs.

2. Lifestyle App; Not Medical Advice

1. The App is a lifestyle, wellness, and nutrition diary application. The App is intended only to help users track meals, calories, macronutrients, weight, and related nutrition information for personal informational purposes.
2. CalPal.Pro is not a medical device, healthcare service, telemedicine service, clinical nutrition service, or professional dietitian service. The App does not provide medical advice, diagnosis, treatment, prevention, or professional dietary advice.
3. Nutritional values, calorie estimates, macronutrient estimates, meal interpretations, charts, goals, and other outputs generated by the App may be incomplete, inaccurate, or unsuitable for your personal circumstances. The App uses artificial intelligence and automated calculations, and its outputs should be treated as estimates only.
4. CalPal.Pro is not affiliated with, endorsed by, certified by, approved by, or sponsored by any government agency, public health authority, medical organization, healthcare organization, hospital, clinic, ministry of health, regulator, or professional dietetic association in any country.
5. The App does not claim that its outputs are based on government-approved, clinically validated, medically certified, or regulator-approved nutrition sources. You should not rely on the App as a substitute for information or advice from a qualified healthcare professional.
6. If you have any medical condition, dietary restriction, food allergy, eating disorder, pregnancy-related nutritional need, diabetes, kidney disease, cardiovascular condition, or any other health concern, you should consult a physician, registered dietitian, or other qualified healthcare professional before making diet, nutrition, weight-loss, exercise, or lifestyle decisions.
7. You are solely responsible for decisions you make based on information displayed in the App. Do not disregard, delay, or replace professional medical advice because of information provided by CalPal.Pro.

3. Data Collection and Use

1. The App collects required information users voluntarily provide ("Submitted Content"), such as meal entries, food or product information, voice input, quantities, dates, nutrition goals, body details entered by you, and related nutrition history.
2. When you sign in, the App also collects your account identifiers provided by the authentication services, including:
   • Non-personalized user IDs provided by Apple, Google and/or Telegram; and
   • Your email address (as provided by Apple, Google and/or Telegram, when available).
   These identifiers are used to create and manage your account, authenticate you, and match your data across sessions/devices.
3. The App does not collect cookies for tracking.
4. The information you provide is stored securely in the App’s database and is used for:
   • Providing core functionality (meal tracking and nutrition calculations);
   • Account identification and security (including preventing fraud/abuse);
   • Analytics and diagnostics (understanding usage patterns and improving the App);
   • Error and performance monitoring (collecting and analyzing crash/error logs to improve stability).

4. User Responsibilities

1. You are responsible for ensuring the accuracy of the information you provide to the App, including meal descriptions and weights.
2. The nutritional information provided by the App is for informational purposes only and should not be considered medical or professional dietary advice. Always consult a healthcare professional for specific dietary or nutritional needs.
3. You agree not to use the App for any unlawful or unauthorized purposes.

5. Data Input

1. The App uses AI to process Submitted Content and generate meal or nutrition results. Raw voice recordings and raw photos are processed transiently and are not stored permanently by the App.
2. The AI service processes only the context needed to calculate calories, proteins, fats, carbohydrates, sugar, and related nutrition estimates.
3. AI requests may include personal data only if it is present in Submitted Content. We do not intentionally send your account email, authentication IDs, payment data, or full account profile to the AI service unless you include that information yourself.
4. Voice data is collected only when you choose voice input and grant microphone permission. Voice audio is used to create a transcript and/or meal analysis and is not used for advertising, biometric identification, or user profiling.
5. By using the App's input features, you consent to processing of your data solely to provide meal logging, nutrition estimates, and related App functionality.

6. Privacy and Security

1. The App prioritizes the protection of user data. Your information is stored securely and is not shared with third parties except as required by law or as needed to operate the App, including authentication, payments, analytics, crash/error monitoring, hosting, and AI processing providers.
2. We do not sell your personal information.

4. Users may edit or delete their entries and account settings at any time using the App's built-in features. Account deletion is permanent and cannot be undone.

7. Analytics and Performance Monitoring

1. The App and its hosting provider may collect non-personal data, such as:
   • Performance metrics (e.g., loading times, server response times).
   • Device information (e.g., mobile browser type, operating system).
   • General usage data (e.g., number of app visits, page views, error logs).
2. This data is collected solely for the purpose of improving the App’s performance, user experience, and troubleshooting technical issues.
3. For analytics and diagnostics, the App may associate events and error/performance logs with your account identifiers (including your email and service-provided user IDs) to:
   • Identify affected users when investigating bugs;
   • Measure reliability and performance by user segments; and
   • Improve overall stability and user experience.
4. By using the App, you agree to the collection of this data for the above purposes.

8. Subscription and Cancellation

1. CalPal.Pro offers two subscription types: monthly and annual. A paid subscription is required for ongoing full functionality after any eligible free trial or introductory access ends.
2. Free trials or introductory offers are available only when displayed in the App and configured by the applicable subscription provider. Trial availability, duration, eligibility, renewal, and cancellation rules may vary by platform and storefront.
3. All payments and subscription management are handled securely through App Store, Google Play or Stripe. CalPal.Pro does not directly process or store payment information.
4. If a user chooses to cancel their subscription, no further payments will be charged. The cancellation will take effect at the end of the current billing period (monthly or annual, depending on the selected plan). Refunds for the current period are not provided, but users will retain full access to the App until the period concludes according to the Subscription provider.

9. Limitation of Liability

1. CalPal.Pro is provided "as is", without warranties of any kind. Despite our best efforts to ensure accurate nutritional information, we cannot guarantee completeness or accuracy.
2. CalPal.Pro, its developers, and affiliates shall not be held liable for any inaccuracies or issues arising from the use of the App, including but not limited to dietary or health consequences.

10. Changes to These Terms

1. These Terms may be updated from time to time to reflect changes in the App’s features or legal requirements. Users will be notified of significant updates. Continued use of the App after such updates constitutes acceptance of the revised Terms.

11. Governing Law

1. These Terms are governed by and construed in accordance with the law. Any disputes arising out of or related to these Terms shall be resolved exclusively in the court.
